Warranty Policy
Last updated: September 28, 2026
At DERMAX BIOCOSMETIC LABS LLC, we are committed to providing our professional services with diligence, organization, and attention to the requirements established for each project.
This Policy establishes the general conditions applicable to warranties, corrections, claims, and, where applicable, products marketed or distributed by DERMAX.
Specific conditions agreed through a contract, proposal, quotation, invoice, purchase order, or other written document will prevail over this Policy where they establish particular terms.
1. Warranty for Professional Services
DERMAX warrants that contracted services will be performed in accordance with the agreed scope and with a reasonable standard of professional diligence.
If the client identifies a material error directly attributable to DERMAX in a deliverable included within the contracted service, the client may request its review.
When it is determined that the error is attributable to DERMAX, the corresponding correction will be made at no additional cost, provided that:
- It falls within the originally contracted scope.
- The information provided by the client was accurate and complete.
- It is not the result of a subsequent change requested by the client.
- It is not the result of regulatory changes or third-party criteria.
- It does not relate to information incorrectly provided by a manufacturer, laboratory, supplier, or other third party.
2. Regulatory and Health-Related Services
DERMAX services related to registrations, permits, notifications, licenses, and other health-related regulatory procedures constitute support, management, and coordination services.
Engaging DERMAX does not constitute a guarantee that the procedure will be approved.
The competent authorities retain full discretion to:
- Approve an application.
- Reject it.
- Request additional information.
- Issue requirements.
- Require modifications.
- Suspend a proceeding.
- Modify their criteria.
- Modify requirements.
- Modify response times.
DERMAX will be responsible for the proper performance of activities within its control and within the contracted scope, but not for administrative decisions made by public authorities.
3. Trademark Registration
DERMAX likewise does not guarantee that a trademark will be granted.
An application may be subject to:
- Registrability assessments.
- Previously existing trademarks.
- Graphic, phonetic, or conceptual similarities.
- Oppositions.
- Objections.
- Requirements.
- Decisions of competent authorities.
Where DERMAX has prepared or managed an application in accordance with information approved by the client, a refusal by the authority does not, by itself, constitute a failure to perform the service.
4. Documents and Information Provided by Clients
No warranty will apply to errors or consequences resulting from information that is:
- False.
- Incomplete.
- Incorrect.
- Outdated.
- Contradictory.
- Provided after the applicable deadline.
This includes information originating from the client, manufacturer, laboratory, supplier, trademark owner, or any other third party related to the project.
If, after the service has commenced, the client modifies aspects such as:
- Manufacturer.
- Formula.
- Ingredients.
- Presentation.
- Product designation.
- Trademark.
- Label.
- Owner.
- Importer.
- Country of origin.
- Technical documentation.
DERMAX may determine that such modifications constitute additional work subject to a new quotation.
5. Regulatory Changes
Regulations applicable to the cosmetics, health, customs, and intellectual property sectors may change during the execution of a project.
When an authority establishes new requirements after the service has commenced, DERMAX will inform the client when such modification is relevant to the project.
Additional work resulting exclusively from new requirements may generate additional costs when it exceeds the scope originally contracted.
6. Official Fees and Third-Party Expenses
The following amounts, among others, do not constitute DERMAX's fees when charged by third parties:
- Government fees.
- Official charges.
- Payments to authorities.
- Laboratory testing.
- Translations.
- Legalizations.
- Apostilles.
- Fees of external professionals.
- Courier services.
- Transportation.
- Storage.
- Customs costs.
Unless the corresponding third party authorizes a refund, these amounts will not be refundable by DERMAX once they have been paid or committed.
7. Cancellation of Services
When the client requests cancellation of a service before it begins, DERMAX will evaluate the request taking into account administrative costs, commitments already undertaken, and the conditions established in the corresponding proposal.
Once the service has commenced, fees corresponding to work actually performed will not be refundable, unless:
- A mandatory legal provision establishes otherwise.
- DERMAX expressly agrees to another solution in writing.
When a project is divided into stages, the amount corresponding to activities actually performed up to the cancellation date may be calculated.
8. Advance Payments
An advance payment may be used to:
- Reserve work capacity.
- Begin analysis.
- Review documentation.
- Prepare files or submissions.
- Coordinate third parties.
- Perform administrative activities.
- Make previously authorized payments.
The existence of an advance payment does not necessarily mean that the entire amount is refundable if work has already commenced.
Specific refund conditions established in a quotation or contract will prevail.
9. Products Marketed or Distributed by DERMAX
When DERMAX directly markets physical products, such products must reasonably correspond to:
- Their identification.
- Reference.
- Presentation.
- Batch.
- Applicable commercial documentation.
Claims related to damage, shortages, or defects must be submitted within the period specified in the corresponding invoice, contract, or order or, if no specific period is provided, within a reasonable period after receipt of the goods.

- Batch number.
- Invoice.
- Evidence of the packaging.
- Description of the problem.
- Quantity affected.
- Additional information necessary to evaluate the claim.
10. Products Damaged During Transportation
When transportation has been arranged directly by DERMAX, claims for visible damage must be reported as soon as reasonably possible and accompanied by photographic evidence of the packaging and product received.
When transportation has been arranged directly by the buyer or risk has transferred in accordance with the applicable Incoterm or logistics condition, the claim may be the responsibility of the carrier, insurer, or other responsible party.
The conditions agreed for each international transaction will prevail.
11. Manufacturing Defects
When DERMAX distributes products manufactured by a third party, defects attributable to the manufacturing process may be subject to a joint investigation with the manufacturer.
Depending on the outcome of the evaluation, the solution may consist of:
- Replacement of affected units.
- Credit note.
- Replacement in a subsequent order.
- Return.
- Another agreed commercial solution.
The solution will depend on the nature of the defect, the manufacturer's conditions, applicable law, and the corresponding contract.
12. Product Warranty Exclusions
Unless applicable law provides otherwise, the warranty may exclude problems resulting from:
- Improper storage.
- Exposure to temperatures outside recommended conditions.

The manufacturer's instructions, warnings, and protocols must be followed.
14. Professional and B2B Sales
DERMAX primarily conducts activities directed toward the professional and business markets.
Distributors, professionals, aesthetic centers, importers, and other professional buyers are responsible for verifying that they possess the authorizations, technical conditions, and knowledge required to market, store, or use the products purchased.
